Terms of Service

Welcome to Mercer Twain. These terms explain what you can expect from us and what we expect from you. We've kept them short and plain. If something isn't clear, email us at support@mercertwain.com.

Who we are

Mercer Twain is a service of Catalyst Holdings LLC, a Wyoming limited liability company with operations in Damascus, Oregon. When we say "we," "us," or "Mercer Twain," we mean Catalyst Holdings LLC. When we say "you," we mean anyone using the service.

Your account

To send mail through Mercer Twain, you either use guest checkout (no account required) or create an account. If you create an account, you're responsible for keeping your login credentials secure. Don't share your password. Let us know right away if you think someone else is using your account without permission.

You must be at least 18 years old to create an account or make a purchase. Mercer Twain is not intended for children.

What you can send

We print and mail what you send us, but we reserve the right to refuse anything we believe:

  • Violates any law
  • Threatens, harasses, or intimidates the recipient
  • Contains hate speech, incitement, or content that could cause physical harm
  • Infringes someone else's copyright or trademark
  • Contains sexually explicit material
  • Impersonates another person, business, or government agency
  • Is intended to defraud the recipient

If we refuse a send for these reasons, we'll refund you. If we discover after mailing that content violated these rules, we may close your account and take whatever other action we deem appropriate.

Our mail carrier is the United States Postal Service. USPS has their own rules about what can be mailed, and we follow them.

Pricing and payments

Prices are listed on the site and at checkout. Prices are in US dollars. We use Stripe to process payments — we never see or store your full credit card number.

Member subscriptions are billed annually at $19.99/year and renew automatically until you cancel. You can cancel anytime from your billing settings. When you cancel, you keep Member access through the end of your current billing period.

Founding Member pricing: if you became a Member during our launch window, your $19.99/year price is locked for three years from your subscription start date. After that period, your subscription renews at whatever the then-current standard Member price is. We'll email you before any price change takes effect.

Refunds

Per-send purchases. If we haven't printed your mail yet, we'll refund it on request. Once we've printed it, we can't refund it because we've already incurred the cost. That said, if something went wrong on our end and you're not happy, email us — we'll make it right.

Member subscription. Member subscriptions are non-refundable after the first 7 days. If you cancel within 7 days of starting a Member subscription, email us and we'll refund you. After that, you can cancel anytime and you'll retain access through the end of your billing period, but we don't issue prorated refunds.

Beta users, trial users, and promo code redemptions. These don't involve a payment, so there's nothing to refund.

Delivery

We send real USPS mail. We can't guarantee specific delivery dates — USPS controls final delivery. Typical delivery times:

  • First Class Letter: 3–5 business days
  • Postcard: 3–5 business days
  • Greeting Card: 3–7 business days
  • Certified Mail: 3–7 business days

Certified Mail includes USPS tracking. Other mail types do not.

If your mail is returned to us as undeliverable, we'll email you. If it's lost in transit by USPS, we'll work with you to resolve it but we're not responsible for USPS delays or losses.

Your content

When you send mail through Mercer Twain, you keep ownership of whatever you write, upload, or include. You grant us a limited license to print, mail, and store your content solely to provide the service. We don't claim ownership of your messages, photos, or greeting card text.

We retain mailing records (recipient names, delivery addresses, send dates) for a reasonable period for legal, operational, and support reasons. See our Privacy Policy for details.

Our content

Mercer Twain designs, card artwork, the Mercer Twain name and logo, and the website itself belong to us. You can't copy or redistribute them without permission, except as necessary to use the service normally.

Service availability

We try to keep Mercer Twain running smoothly, but we can't promise the service will always be available or error-free. We may need to take the site down for maintenance or updates. If we make changes that materially affect how the service works, we'll let you know.

Changes to these terms

We may update these terms from time to time. If we make significant changes, we'll email active users and post a notice on the site. Your continued use of Mercer Twain after changes take effect means you accept the new terms.

Account termination

You can close your account anytime. Email us at support@mercertwain.com or use the cancel option in your settings.

We may suspend or close your account if you violate these terms, attempt to defraud us, or cause harm to other users or recipients. We'll typically give you notice first unless doing so would make the problem worse.

Limitation of liability

Mercer Twain is provided "as is." To the maximum extent allowed by law, we are not liable for indirect, incidental, or consequential damages arising from your use of the service. Our total liability for any claim related to the service is limited to the amount you paid us in the twelve months before the claim.

This doesn't limit any rights you have under law that can't be waived.

Dispute resolution and arbitration

Try to work it out first. If you have a problem with Mercer Twain, email us at support@mercertwain.com. Most issues get resolved quickly that way. We'll try in good faith to resolve any dispute informally for at least 30 days before escalating.

Binding arbitration. If we can't resolve it informally, any dispute between you and Mercer Twain will be resolved through binding arbitration rather than in court, except that either party may bring claims in small claims court if they qualify.

The arbitration will be administered by JAMS under its Streamlined Arbitration Rules. The arbitration will take place in Wyoming, or remotely, or in another location we both agree to. Each party pays their own legal fees and costs unless the arbitrator awards otherwise.

Class action waiver. You and Mercer Twain both agree that any arbitration or legal action will be brought on an individual basis only. Neither of us may bring a claim as a plaintiff or class member in a class, collective, or representative action.

Governing law. These terms are governed by the laws of the State of Wyoming, without regard to its conflict-of-law rules.

Opt-out. If you don't want to be bound by arbitration, you can opt out by emailing support@mercertwain.com within 30 days of first creating an account. Include your account email and a clear statement that you're opting out of arbitration.
